RAPAC Demands Arlington Prosecutor’s Records

Following yesterday’s blockbuster revelation in the Washington Post, that the material referred by Loudoun Commonwealth’s Attorney James Plowman to Arlington Commonwealth’s Attorney Theophani Stamos did not include the full record in the possession of chairman Scott York, the question arises: what did each prosecutor actually have?

To answer that question, RAPAC has issued two new Freedom of Information Act requests, one to Mr. Plowman, one to Ms. Stamos. The content of each submission is identical, and is set out below. Watch this site for updates.

This is a demand under the Virginia Freedom of Information Act for the following items:

1. All communications from Commonwealth’s Attorney James Plowman to Commonwealth’s Attorney Theophani Stamos relating to, but not including, written statements made by Donna Mateer.

2. All communications from Commonwealth’s Attorney Theophani Stamos to Commonwealth’s Attorney James Plowman relating to, but not including, written statements made by Donna Mateer.

3. Written statements made by Donna Mateer received by Commonwealth’s Attorney James Plowman.

4. Written statements made by Donna Mateer received by Commonwealth’s Attorney Theophani Stamos.

Please note that, if any exceptions or other objections under the Freedom of Information Act are made to the production of any one or more of the items called for above, each of the demands for the remaining items is to be treated as a separate demand to be replied to on its own.

Also, it is our view that, having determined that her office will take no action on the materials Commonwealth’s Attorney Stamos received from Commonwealth’s Attorney Plowman, the “active investigation” exception provided for in § 2.2-3705.3(3) of the Act does not apply and, to the extent that any items requested above are within the meaning of “inactive reports” as that phrase is used in § 2.2-3705.3(3) of the Act, we are demanding those items in a form that does not reveal the identity of charging parties, persons supplying the information or other individuals involved in the investigation.
